Welcome to Sport Faction! By accessing or using any of our services, games, or digital collectibles, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully before using our platform.

The company (referred to as "the Company," "We," "Us," or "Our" in this Agreement) refers to Sport Faction SA, 140 rue du Chevaleret, 75013 Paris. For the purpose of GDPR compliance, the Company acts as the Data Controller.
1. Introduction
Sport Faction is an innovative sports entertainment platform where fans can connect with their favorite athletes and teams in unique and interactive ways. By leveraging blockchain technology, Sport Faction enables users to acquire, collect, and interact with digital collectibles representing professional athletes (“Collectibles”). These collectibles offer exciting opportunities, such as exclusive rewards, game enhancements, and engagement with the sports community.
Through our mobile games and upcoming marketplace, users can:
- Purchase and collect digital figurines of athletes.
- Compete in interactive gameplay experiences featuring these collectibles.
- Unlock rewards, such as signed merchandise, VIP access, or meet-and-greet opportunities.
These Terms of Service (“Terms”) govern your use of the Sport Faction platform, including its mobile applications and services. Additional terms (“Additional Terms”) may apply depending on how you use the platform, such as:
- The Marketplace Terms, for buying, selling, or trading Collectibles.
- Contest or Game Rules, for participating in competitive events.
- Payment Provider Terms, for processing transactions.
By using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
The Terms and any applicable Additional Terms form a legally binding agreement between you and Sport Faction (“the Agreement”). Please read these Terms carefully. If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.
2. Eligibility
To use our platform, you must:
- Be at least 18 years old or the age of majority in your jurisdiction.
- Have the legal capacity to enter into a binding agreement.
Failure to meet these eligibility criteria or providing false information during account creation may result in immediate account suspension or termination.
By creating an account or using our services, you confirm that you meet these eligibility requirements. We reserve the right to request proof of eligibility at any time.
3. Account Creation and Security
3.1 Account Creation
To create an account with Sport Faction, you must provide accurate and complete information, including:
- A unique username.
- A valid email address.
Alternatively, you may sign up through third-party services such as Google or Apple, where supported. By creating an account, you represent and warrant that:
- You are at least 18 years old.
- You agree to these Terms of Service and all applicable laws and regulations.
- You are not located in a country subject to embargo restrictions or listed as a restricted party under applicable laws.
You are responsible for ensuring the accuracy of your information and must update it as necessary to maintain access to the platform.
3.2 Account Use
Your account is for personal, non-commercial use only. You agree not to:
- Create more than one account.
- Share your account credentials with third parties.
- Create accounts on behalf of others or act in coordination with others to circumvent these Terms.
3.3 Username Selection
- You must select a username that does not mislead, offend, or infringe on the rights of others.
- Offensive, harassing, or otherwise inappropriate usernames are prohibited.
- Username changes are restricted to once every three months.
3.4 Account Security
- You are solely responsible for safeguarding your account credentials, including using strong passwords and enabling two-factor authentication (where available).
- Sport Faction is not liable for unauthorized access resulting from your failure to secure your account.
- Notify us immediately of any unauthorized access or suspicious activity on your account by contacting our support team.
It is recommended to regularly update your password and avoid phishing attempts to enhance security.
3.5 Prohibited Account Activities
- Multiple Accounts: Creating or operating multiple accounts is strictly prohibited.
- Account Sharing: You may not share your account or allow others to access it on your behalf.
- Account Recreation: If your account has been suspended or terminated, you may not create a new account without prior authorization.
Sport Faction reserves the right to terminate accounts involved in prohibited activities without notice.
4. Ownership
4.1 Collectibles
Sport Faction’s digital collectibles are unique digital items featuring athletes, leveraging blockchain technology to ensure their authenticity, scarcity, and ownership. Each collectible is backed by a non-fungible token (NFT), providing proof of ownership on a blockchain ledger.
4.2 Ownership of Collectibles
When you purchase a collectible, you become the sole owner of the associated NFT, in accordance with these Terms. Ownership grants you the right to transfer, sell, or display the collectible for personal, non-commercial use. However, Sport Faction retains ownership of the intellectual property rights to the content within the collectible (e.g., athlete images, branding, or designs).
Ownership of collectibles does not include rights to reproduce, distribute, publicly display, or create derivative works of the collectible’s content, including athlete images or branding.
4.3 License to Use Content
As a collectible owner, you are granted a limited, non-exclusive, and non-commercial license to use, display, and transfer the digital content embedded in the collectible, such as player images or trademarks. This license lasts as long as you own the associated NFT and is automatically transferred to the new owner if the collectible is sold or transferred.
You may not:
- Use the collectible or its content for any commercial purposes, including but not limited to advertising, promotion, or the creation of any branded content, without prior written consent from Sport Faction. For influencers, creators, or users wishing to engage in commercial activities, a separate commercial licensing agreement must be obtained from Sport Faction.
- Alter, modify, or create derivative works from the content.
- Use the collectible in a manner that violates applicable laws or infringes the rights of others.
If you transfer or dispose of your collectible, your license to its content terminates immediately.
4.4 Third-Party Rights
Some elements of the collectibles, such as player images, team logos, or trademarks, are licensed from third-party rights holders. You agree to comply with any restrictions or conditions related to these rights, as outlined in these Terms.
5. Payments
5.1 Payment Processing
When you make a payment in connection with Sport Faction’s services, your payment will be processed by a trusted third-party payment provider (“Payment Provider”). The Payment Provider’s terms of service and privacy policy govern your transaction and may require you to provide additional information to verify your identity or validate the transaction.
5.2 Blockchain Transactions
Due to the nature of blockchain technology, all transactions involving digital collectibles are recorded on the blockchain and are irreversible once processed. Please ensure the accuracy of all transaction details, including wallet addresses, before confirming any payments.
5.3 Payment Declines or Holds
Your payment may be declined, delayed, or held for various reasons, including but not limited to suspected fraud, adherence to legal and regulatory requirements, or compliance with Sport Faction’s risk management policies.
5.4 Fees
Certain transactions, such as blockchain transfers, may incur additional fees (e.g., gas fees) that are the sole responsibility of the user. These fees will be disclosed prior to completing the transaction where applicable.
6. Payments
6.1 Payment Processing
Payments made through Sport Faction are processed via trusted third-party payment providers (“Payment Providers”). By using these services, you agree to their terms and conditions. Payment Providers may require additional information to verify your identity or validate transactions.
6.2 Blockchain Transactions
All blockchain-based transactions, including purchases or transfers of digital collectibles, are final and irreversible once processed. Please be aware that blockchain transactions are final and irreversible once processed. Before confirming any transaction, double-check all transaction details, including wallet addresses. We recommend testing small amounts for first-time transactions or using our transaction review feature if available. Sport Faction is not responsible for errors or lost assets due to user mistakes in entering transaction details.
6.3 Fees
Certain services, such as blockchain transactions, may incur fees (e.g., gas fees). These fees are the user’s responsibility and will be disclosed before processing.
6.4 Payment Issues
Payments may be delayed, declined, or held due to suspected fraud, regulatory compliance, or risk management policies. Sport Faction is not responsible for disruptions caused by third-party Payment Providers.
7. Marketplace (Future Feature)
Sport Faction plans to introduce a dedicated marketplace for buying, selling, and trading digital collectibles. This marketplace will provide users with a secure and transparent platform for peer-to-peer transactions. Until the Marketplace is launched, users are encouraged to manage their collectibles via third-party services, such as external wallets and platforms. Please note that Sport Faction is not liable for any losses, issues, or disputes that may arise from the use of third-party services. Sport Faction recommends using trusted, well-established services and encourages users to review their respective terms and conditions.
8. Prohibited Use
To maintain the integrity and proper functioning of Sport Faction’s platform, users agree not to:
- Post content that is misleading, fraudulent, offensive, harassing, or otherwise harmful.
- Interfere with, disrupt, or attempt unauthorized access to other users’ accounts or wallets.
- Use automated tools, bots, or scripts to access or manipulate the platform.
- Impersonate another person or entity or misrepresent your affiliation with Sport Faction.
- Engage in fraudulent transactions, price manipulation, or other deceptive activities.
- Violate any applicable laws, regulations, or these Terms.
If you encounter content that violates these Terms, you may report it to Sport Faction by using the ‘Report’ feature available on the platform or by contacting our support team. Users whose content is flagged for violations will be notified and given an opportunity to appeal the decision. Appeals must be submitted within 30 days, and our team will review the matter in accordance with our content moderation policy.
Sport Faction reserves the right to suspend or terminate accounts and take appropriate action against users who violate these rules.
9. Liability
9.1 General Disclaimer
To the fullest extent permitted by applicable law, Sport Faction, its affiliates, officers, agents, consultants, vendors, equity holders, employees, successors, assigns, directors, partners, subsidiaries, contractors, and licensors disclaim all liability arising out of or in connection with the platform, including but not limited to:
- Reliance on any information or data made available through the platform or associated communications.
- Loss of user data, collectibles, or any other digital assets.
- Interruptions or errors in the platform’s operation, including bugs, breaches, or system malfunctions.
- Events beyond Sport Faction’s control, such as force majeure, cyberattacks, or third-party technology failures.
- Any indirect, incidental, or consequential damages arising from your use of the platform.
9.2 User Acknowledgement
Users understand and accept the inherent risks associated with the use of blockchain technology, digital collectibles, and experimental internet-based services. Sport Faction shall not be held liable for:
- Security vulnerabilities inherent in blockchain systems or wallets, including the loss of private keys.
- The irreversible nature of blockchain transactions, which may result in loss due to errors or fraudulent activities.
- Fluctuations in the value of digital collectibles and any losses incurred as a result.
9.3 Limitation of Liability
To the fullest extent permitted by applicable law, Sport Faction’s total liability for any claim arising under or in connection with these Terms is limited to the total amount paid by the user for services or products over the 12-month period preceding the claim. In cases of significant financial loss (such as for premium users or those with high-value assets), Sport Faction may consider reviewing the issue on a case-by-case basis to determine a fair resolution.
10. Account Deletion and Termination
10.1 Account Deletion
Users may terminate these Terms at any time by requesting the deletion of their account and discontinuing the use of the platform. Account deletion will result in the irreversible loss of user data and any associated digital assets not transferred prior to deletion. Upon account deletion, any digital collectibles or other assets linked to your account will be permanently lost and cannot be recovered. Before initiating deletion, we strongly recommend transferring any assets you wish to keep. If you wish to transfer assets, please do so within 30 days prior to requesting account termination. Sport Faction will not be liable for the loss of any assets not transferred before account deletion.
10.2 Account Termination
Sport Faction reserves the right to suspend or terminate user accounts at its sole discretion and without prior notice, especially in cases of Terms violations or misuse of the platform.
11. Amendments
Sport Faction reserves the right to amend these Terms at any time. Users will be notified of material changes via appropriate communication channels.
12. User Support
If you encounter any issues with your account, collectibles, or transactions, you may contact Sport Faction’s customer support team at contact@sportfaction.com or via our Discord support portal. Our team will respond within 10 business days. In the event of technical issues, lost assets, or disputed transactions, we will work with you to investigate and resolve the matter in a timely manner.
13. Data Protection
Sport Faction is committed to protecting your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). As the Data Controller, we collect, process, and store your personal information only for the purpose of providing our services. For more details on how we handle your data, including your rights under GDPR, please refer to our Privacy Policy.
14. Miscellaneous
Failure to enforce any provision of these Terms does not constitute a waiver. If any provision is deemed unenforceable, the remaining provisions remain in effect.
